1. Acceptance of Terms

By accessing or using any software, website, or service provided by Bezalel Design Lab ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our products or services. These Terms apply to all visitors, users, and customers.

2. Description of Services

Bezalel Design Lab provides civil engineering software tools, including but not limited to the HydraLink hydrology and hydraulics modeling application (collectively, "Software"). Our services include software licensing, updates, documentation, and customer support as described on our website.

3. Account Registration

To use our Software, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years of age to create an account. By registering, you represent that you meet this requirement.

4. Software License

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for your professional engineering work. Each license is limited to the number of seats (computers) purchased. A single-seat license permits activation on one computer at a time. Multi-seat licenses permit activation on up to the purchased number of computers. You may transfer your license to a different computer by deactivating it on the current machine first. This license does not permit you to:

  • Redistribute, sublicense, sell, or lease the Software to any third party
  • Reverse engineer, decompile, or disassemble the Software
  • Remove or alter any proprietary notices or labels on the Software
  • Use the Software to develop a competing product or service
  • Share your license key or account credentials with others
  • Activate the Software on more computers than the number of seats purchased

5. Subscription Plans and Billing

We offer annual and multi-year subscription plans, as well as multi-seat licenses at volume-discounted rates. By selecting a subscription:

  • Annual and Multi-Year Plans: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate at the time of renewal.
  • Multi-Seat Licenses: Volume discounts are applied based on the number of seats purchased. All seats are managed under a single license key and account.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to the Software until then. No partial-period refunds are issued for cancellations.
  • Free Trial: New accounts may receive a 7-day free trial with full access to all features. No payment information is required to start a trial. If you do not subscribe before the trial ends, your access to paid features will be suspended. Free trials are limited to one per person or organization.

6. Refund Policy

We offer a 30-day money-back guarantee on all initial purchases. If you are not satisfied with the Software, contact us within 30 days of your purchase date for a full refund. Refunds for renewal payments are provided on a prorated basis at our discretion. Third-party payment processing fees are non-refundable and are absorbed by the Company. Upon refund, your license will be deactivated.

7. Acceptable Use

You agree not to use our services to:

  • Violate any applicable local, state, national, or international law or regulation
  • Transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of our services
  • Use automated tools to scrape, crawl, or extract data from our website

8. Intellectual Property

All content, software, designs, text, graphics, and other materials on our website and within our Software are the property of Bezalel Design Lab or our licensors and are protected by United States and international copyright, trademark, and intellectual property laws. Your use of our services does not grant you any ownership rights in our intellectual property.

9. Data and Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.

10. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WHILE WE STRIVE FOR ACCURACY IN OUR ENGINEERING CALCULATIONS, WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED. YOU ARE RESPONSIBLE FOR INDEPENDENTLY VERIFYING ALL ENGINEERING CALCULATIONS AND DESIGNS PRODUCED USING OUR SOFTWARE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEZALEL DESIGN LAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SOFTWARE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Professional Responsibility

Our Software is intended as a professional tool to assist licensed engineers. It does not replace the judgment, expertise, or professional responsibility of a licensed professional engineer. All output from the Software should be reviewed and verified by a qualified professional before being used in any design, construction, or regulatory submission. You bear sole responsibility for any engineering decisions made using our Software.

13. Termination

We may suspend or terminate your access to our services at any time if you violate these Terms or engage in conduct that we determine to be harmful to our business, other users, or third parties. Upon termination, your license to use the Software is immediately revoked and all machine activations are deactivated. Sections 8, 10, 11, 12, and 14 survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws provisions. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Texas. You agree to waive any right to a jury trial or to participate in a class action.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice on our website at least 30 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.
